On March 20, reports surfaced that the SEC is investigating the EF

One week later, the EF proposed changing Ethereum’s issuance curve and is loudly shouted down by the community 

Seems like pretty compelling evidence that the EF doesn’t control the protocol. Coincidence or strategic lawyering? I think the latter

This is an interesting perspective. What, if anything, would make this falsifiable.

I agree 100% the SEC is using its investigation to fish for an excuse to deny the ETF. Despite the chatter on CT, Gensler is not an idiot and he knows he’d get crushed if tried to reclassify ETH as a security

No that makes sense. I actually think there’s another reason for the SEC’s subpoena that has nothing to do with the EF. According to Laura Shin’s podcast, they’re looking for info ammo in the ETH ETF lawsuits, not to actually go after the EF. In that case, they’d not be looking to classify ETH as a security.

Imo, this would be falsifiable if: 
(i) researchers didn't expect the public outcry (unlikely)
(ii) the timeframe for releasing the proposal was established pre-subpoena (fairly likely)
(iii) researchers never discussed with counsel (???)

tbh I'm really looking for a silver lining in a rough time for us ETH stans 😅
