What will the judge allow or consider irrelevant during Roman Storms trial? - neither the prosecution nor the defence are allowed to use the words “KYC” or “AML” - witnesses are not allowed to say words such as “illegal” or “legal” - no discussions relating to Van Loon or OFAC sanctions - Roman’s defense cannot argue about the scope of money transmission laws as they relate to control, fees, or profit-making - testimonies on the applicability FinCen or Bank Secrecy Act are “irrelevant” - judge is not particularly interested in discussing free speech and privacy rights - judge does not think free speech or first amendment issues should be coming up If that wasn’t enough, the judge also announced last Friday that the trial is will run for 2 weeks longer than expected, doubling the cost for Roman’s trial. The prosecution also added in last minute witnesses (7 days after the deadline) that allegedly used TC for crypto thefts, as well as key evidence previously withheld from the defence that proves TC was secretly operated as a money laundering service by using a phone allegedly belonging to Alexey Pertsev. This all news in the last 7 days. If you have the means, please help support Roman. The government has all the resources to bleed him dry before they reach a verdict.

What's the reason behind not being able to say KYC or AML?

The judge believes it will confuse the jury as the government is no longer pursuing fed registration violations with OFAC. The thing is, despite Van Loon winning the case to de-sanction OFAC, Roman is charged under the North Korea sanctions program, which is different than Tornado Cash’s sanctions. So while it’s been a big W for the industry, it hasn’t changed anything with Roman’s case. IMO it’s unfair that these terms would be irrelevant when he’s still facing 1 count of sanctions evasion - that charge alone could make him face up to 20 years in prison
