Paradigm filed an amicus brief last week in United States v. Storm, advocating for jury instructions that will hold the government to its burden of proof on the mens rea needed to convict Roman Storm for money transmission violations under 18 U.S.C. § 1960. The case goes to trial on July 14 and will have a lasting impact on crypto and software development more generally. If I just minted our brief as an NFT, it would definitely not be a security! But there would have to be a lawsuit before anyone could submit an amicus brief (and if we were a party to the lawsuit, we wouldnât be able to submit an amicus)!

We filed our amicus in Lejilex/CFATâs case against the SEC. The lawsuit seeks a declaratory judgment that crypto secondary sales are not securities and Lejit.Exchange is not an exchange, broker, or clearing agency, and to enjoin SEC enforcement. Filed our amicus brief supporting the @blockchainassn and CFATâs challenge to the SECâs new dealer rule. The rule meaningfully expands and muddies the definition of who is a securities âdealerâ and may be used to sweep in broad swaths of DeFi.
