SEC has expressed concern about the launch of ETFs on Ethereum and Solana from REX Financial and Osprey Funds. These funds assume income generation through staking, but may not meet the legal definition of an ETF under federal law. The launch has been postponed until issues with the SEC are resolved.

SEC Commissioner Caroline Crenshaw criticized the agency's approach, saying that crypto assets "are sometimes recognized as securities, sometimes not — when and how convenient." Bloomberg: Despite the obstacles, ETFs with staking will still appear — it's only a matter of time.
