Well, the post-PATRIOT Act BSA applies to broker-dealers and other securities intermediaries, including national securities exchanges and ATSes. 

And the SEC enforces those rules against those intermediaries during its exams. 

So a decentralized, permissionless, no KYC securities exchange might get some government scrutiny!

My understanding is the SEC can update the rules around exchanges if the clarity bill falls through.
