A very dear friend of the family passed some time ago. I’m charged with carrying out his will and I came across this curious language in it.
“If any beneficiary or remainderman under this Will, any person claiming any portion of my estate by reason of relationship or otherwise, or if any person who, if I died intestate, would be entitled to any part of my estate, shall in any manner, directly or indirectly, contests or attacks this Will or any of its provisions, or attempt to set aside this Will, or to impair, invalidate or set aside any of its provisions, any share or interest in my estate given to the contesting beneficiary under this Will is revoked and I give, devise and bequest to such person or persons, the sum of One Dollar and no more, in lieu of any other share or interest in my estate.”
So, as it turns out one of the beneficiaries is contesting the Will. As estate administrator, I am obligated to inform them of this provision and that person is not happy.
I explained this is the exact antithesis of what my friend wanted - loved ones fighting over what’s left. However, somehow, it’s not about what my friend wanted, it’s about what cut this person wants. And he’s gonna get it - all of $1 - if he shows up to court contesting the Will, that’s all he’ll get. 🙄
