One misunderstanding journalists like you could help clear up in the notion that the previous SEC wanted to do sensible regulation but the industry was opposed. Gensler refused to clarify the rules and tried to see what legal actions the courts would accept instead. Regulation by litigation. Crypto industry has been begging for clarity on the rules.
