The DOJ's charge against the Samourai Wallet devs is based on an incorrect interpretation of Section 1960. Even though the court denied the request to allow amicus briefs in the case, we @fund-defi and @blockchainassn will keep advocating for the correct interpretation - only those with control over customer assets are money transmitters. We will keep beating this drum.

Congress has an opportunity to protect developers of non-custodial peer-to-peer software protocols from being unreasonably targeted for regulation. Today, we — Coin Center, Solana Policy Institute, The Digital Chamber, Blockchain Association, Crypto Council for Innovation, Paradigm, and Bitcoin Policy Institute — are collectively calling on Congressional leaders to support the Blockchain Regulatory Certainty Act (BRCA) by including it in market structure legislation.

2/ Our 5 principles for the Token Safe Harbor, which are described in detail in our letter, are: (1) technology-agnostic approach, (2) broad eligibility criteria for projects intending to decentralize, (3) well-calibrated disclosure and compliance considerations, (4) clearly-defined exit criteria, and (5) appropriate treatment of secondary market activity.

3/ While we wait for Congress to enact market structure legislation, which is absolutely necessary but may take a while, the SEC should offer a Safe Harbor framework that gives DeFi devs a path forward and protects the public by providing for info disclosures.
