Federal district court in Texas halts enforcement on $250 CTR requirements near the southern border. Why do you view it as significant progress? Where is there a lack of clarity today? I’m not anti-legislation on stables, but they’re payment instruments, and non-crypto payment instruments have had relative clarity for decades. Forcing issuers of crypto payment instruments into federal-only regulatory regime at scale decreases competition and is not a tech-neutral approach to regulating payment instruments.

Would be happy to discuss 🙋🏼‍♀️! Depending on the activities involved, some record keeping and reporting thresholds are even lower than $10k (eg $2k). On top of that, programs need to be risk-tailored to the specific business models, which is part of why it’s tough to build a one-size-fits-all solution

I have a small concern that people are over-valuing passage of legislation itself as progress, and under-valuing getting the legislation right. But also, maybe that’s just always the case with legislation of any sort in a democratic system.

I think the SEC *could have* used existing law to promulgate crypto specific rules, but since they didn’t, congress and courts have needed to step in. IOW, I’m not convinced new laws were an inherent necessity so much as a practical necessity, based on - as you say- the approach selected by the agency.

I agree we should all care about stablecoin legislation, but I’m struggling to get excited about or support a bill that (a) blanket bans yield/interest, and (b) forces state-regulated issuers into a federal regime based on market cap, which is not a tech-neutral outcome for payment instruments.

Don’t assume existing laws do not, will not, or should not apply just because the tech is novel. Not everyone in the industry, but the crypto industry as a whole lost in both years and reputation/credibility by making this assumption.
