I think the nature of digital assets means it’s not the same as the gold bars at home. For the reason you describe — proof of ownership can be verified without an intermediary. Ultimately this is just an order to explore how crypto could be used to evaluate mortgage applications, and just because it needs to contemplate assets held with custodians doesn’t mean it must exclude self custody assets. All to say, I’m not actually worried about the policy implications here, and will be interesting to follow developments.

Another reason to revisit the BSA: the dollar thresholds for recordkeeping and reporting have not increased with inflation. The result is that a scheme originally intended to capture truly anomalous and high value / high risk transactions now captures… just about everything.

This warrants its own PSA. Next time you need a summary of a legal doc that’s in PDF (proposed bills, court documents, etc.) use NotebookLM. My experience has been far better than with ChatGPT, Harvey, or copilot.

Anyone have a good resource on the actual legal questions at issue in today’s SCOTUS rulings? Headlines on the substance and facts are are intense, but I’m struggling to find a good summary on what the legal questions before the court actually were.

Fannie and Freddie ordered to consider crypto assets to facilitate mortgage lending, but only if the assets are held with a US regulated exchange (not assets held in self custody). This is a step in the right direction, but the biggest winners from this will be the centralized / regulated FIs.

I’ve yelled to anyone who will listen (and to the void of the social media) about how the $10bn cap on state regulated issuee makes no sense for a 1:1 reserve framework. unforced error by our industry. But! Perhaps the conversation we should’ve been having all along is what’s raised here— which is, why didn’t we figure out a framework for fractional reserve stables?
