I think your point about interest or yield arising “solely” from holding a stablecoin is a good one, but I’d go even further to say that it is likely pretty feasible to structure exchange partnerships so that they’re not “interest or yield” to begin with. Instead they are rev share arrangements, or marketing and distribution payments… that just so happen to be funded by the reserve revenues generated by the issuer.

I’m glad to see so many dems voting in favor of the GENIUS act because crypto should not be partisan. I maintain it’s an unforced error by the industry (and legislators) to impose a 10bn cap on state regulated issuers, but a W is a W. Stablecoins are here to stay (which I never doubted).

I think the nature of digital assets means it’s not the same as the gold bars at home. For the reason you describe — proof of ownership can be verified without an intermediary. Ultimately this is just an order to explore how crypto could be used to evaluate mortgage applications, and just because it needs to contemplate assets held with custodians doesn’t mean it must exclude self custody assets. All to say, I’m not actually worried about the policy implications here, and will be interesting to follow developments.

Another reason to revisit the BSA: the dollar thresholds for recordkeeping and reporting have not increased with inflation. The result is that a scheme originally intended to capture truly anomalous and high value / high risk transactions now captures… just about everything.

This warrants its own PSA. Next time you need a summary of a legal doc that’s in PDF (proposed bills, court documents, etc.) use NotebookLM. My experience has been far better than with ChatGPT, Harvey, or copilot.
