Elizabeth Warren's take is wrong: This hurts startups, not big tech. Big tech has armies of lawyers to comply with whatever the states come up with. But scrappy startups trying to bring a new AI product to market might not be able to handle the massive compliance costs of a 50-state AI regulatory regime. So what the Senate has done doesn't affect Google—but it does prevent the next Google from being built. Well, the post-PATRIOT Act BSA applies to broker-dealers and other securities intermediaries, including national securities exchanges and ATSes. And the SEC enforces those rules against those intermediaries during its exams. So a decentralized, permissionless, no KYC securities exchange might get some government scrutiny!
