History shows that when the government feels threatened, it protects itself first. A clear example is what happened in World War I and II with the Espionage Act of 1917 and the Sedition Act of 1918. These laws were used to jail Americans for handing out pamphlets, criticizing the draft, or speaking against the war. The Sedition Act even punished “disloyal or abusive language” about the government. When people challenged these prosecutions, the Supreme Court upheld them. Cases like Schenck and Debs showed that the courts were willing to limit speech whenever the state claimed it needed more control. The same pattern appeared in World War II with the internment of Japanese Americans. The government ordered it, and the Court approved it. Only decades later did the system admit it was wrong. The pattern is simple. In moments of pressure, the legal system protects the structure of government before it protects individual rights. You do not need to be a historian to see how consistent that pattern has been.
