if there is no human involved in the loop, then definitely made only by AI. an observer needed to classify it as ART or TRASH

It doesn’t matter. It just needs to be encoded in the smart contract that generate art.

In the case of code, code is not art.
Code ownership is shared between all the stakeholders in the soft. That means ai but also yourself.
But it's more management than philosophy.
And in fact, if we want to put the comparison at the max, the code is not art, the purpose of it is. The purpose is not generated yet either

If it's made by the AI, then it's AI.
Is there any AI art?
No. It's statistics with randomness.

Art is fundamentally human as the meaning behind the scene IS important.
AI don't understand (atm) and generate meaning.

The prompt can be art, the generated output is not.
