Yeah, it would be super cool if they do actually implement something which takes advantage of the trustless certification ability for self-custody crypto. But if that's not available day 1 I don't see that as meaning it won't be available as things progress.

I read the clause as "can be" held on registered exchanges and not necessarily had to be held on exchanges, but realistically idk how else it would be evidenced. Not like you can use gold bars in your home safe to prove mortgage credit worthiness (afaik?). I guess they could have a system where people send small transaction to prove they control a wallet where crypto is held or allow ledger or coinbase wallet to partner to KYC and prove identity of wallet controller, but highly doubt any federally sponsored entity is savvy enough to implement something like that.

Elizabeth Warren's take is wrong: This hurts startups, not big tech. Big tech has armies of lawyers to comply with whatever the states come up with. But scrappy startups trying to bring a new AI product to market might not be able to handle the massive compliance costs of a 50-state AI regulatory regime. So what the Senate has done doesn't affect Googleβ€”but it does prevent the next Google from being built. And that puts the US behind in the AI space race. https://x.com/SenWarren/status/1940055045405646911

Bank Secrecy Act should narrow its reach to protect privacy in the crypto age. Initially intended to combat organized crime, it expanded to include nearly every suspicious transaction (called SAR). As finance and trade come onchain, policymakers need to recognise that low-value information from financial data overwhelms law enforcement and erodes people’s privacy. https://www.technologyreview.com/2025/06/25/1119324/katie-haun-bank-secrecy-act-oped/

SEC v. Ripple ends its 5 year battle with a whimper, while the Senate turns to market structure (kinda). Also, I might be able to use my fartcoin bag to qualify for my next mortgage? Here's everything that happened in crypto law last week: https://nfttorney.com/2025/07/01/off-the-blockchain-june-23-30-2025/

For anybody interested, here is the letter I had the honor of co-authoring with some colleagues to the SEC on behalf of the Digital Chamber regarding rule proposal changes for NFTs/Stablecoins/Wrapped Tokens and suggestions to improve discourse between the Commission and the industry. https://www.sec.gov/files/ctf-written-input-jonathan-schmalfeld-daniel-mcavoy-stephen-rutenberg-polsinelli-pc-062725.pdf

Public Safety Reminder: Currently a Google ad result for an AAVE search is what looks like a drainer site. Just a regular reminder to not connect your wallet to sites unless you are mega-super-sure it is the right address. Stay frosty.

Fannie and Freddie ordered to consider crypto assets to facilitate mortgage lending, but only if the assets are held with a US regulated exchange (not assets held in self custody). This is a step in the right direction, but the biggest winners from this will be the centralized / regulated FIs.

I would like to think with the Senate so behind on market structure (Senate bill expected right before or after the August recess), the House won't want to hold it up that long, by Chair Hill has reiterated he thinks GENIUS has problems to be corrected before passing even after President's statement. If I was setting odds, I would put it at 65/35 that it passes the House without amendment/delay, but still a decent chance it gets held up or amended and sent back to Senate.

The GENIUS Act passed the Senate (now just need the House to not mess it up) and DeFi lending hit all time highs. Here's everything that happened in Crypto Law last week: https://nfttorney.com/2025/06/24/off-the-blockchain-june-16-23-2025/
